Enrollment in Annual Irrigation Maintenance Contract

1. Spring Start-Up: Service Provider agrees to perform the annual spring start-up of the irrigation system, which includes inspecting and testing all components of the system to ensure proper functioning for the upcoming watering season.
– Program the automatic controller for proper water operation.
– Replace the automatic controller back-up memory battery if necessary.
– Inspect for leaks on the inside sprinkler plumbing as well as outside.
– Check performance of all valves.
– Cut grass from around each sprinkler head and check for proper coverage.
– Check rain sensors for effective operation, if necessary.
– Cut around valve boxes that are located in grass area.
– Make any necessary repairs to the system.

2. Winterization: Service Provider agrees to perform the annual winterization of the irrigation system, which includes draining all water from the system to prevent freezing and potential damage during the colder months.
– Clear all irrigation lines (blow-out with air compressor).
– Check for leaks or broken lines that need to be repaired in spring.
– Deactivate irrigation controller.

3. Routine Maintenance: Routine maintenance includes the turn-on and blow-out services for the irrigation system. During the turn-on service, any necessary repairs or replacements of sprinkler heads will be conducted. If additional repairs are required beyond the allotted time for routine maintenance, the service will be deemed incomplete, and the Customer must schedule a separate appointment for further repairs. Any repairs conducted during the turn-on service, within the designated time frame, will be billed as time and materials.

4. Repair Services: Service Provider agrees to provide repair services for any issues identified during routine maintenance checks or reported by the Customer. It is essential to note that any repairs not covered under warranty will be billed separately as time, labor, and materials. Customers are encouraged to schedule an appointment with Service Provider prior to undertaking any major work or activities such as aerating to ensure proper coordination and minimize potential damages to the irrigation system.

WARRANTY:
For systems installed by H2O Irrigations, the initial two-year warranty period covers any defects in materials or workmanship. If a design flaw is identified within this warranty period, H2O Irrigations will replace or repair the affected components at no additional charge. However, damages resulting from external factors such as plow damage, work performed by other parties, or any other form of damage not related to the initial installation are not covered under warranty and will be billed as time, labor, and materials.

TERMINATION:
Either party may terminate this Agreement with written notice to the other party. Termination shall be effective upon receipt of such notice.

ACCESS AND AUTHORIZATION:
Customer agrees to provide Service Provider with access to the irrigation system and any necessary facilities for performing the agreed-upon services. Customer authorizes Service Provider to make any necessary repairs or adjustments to the irrigation system as deemed appropriate by Service Provider’s technicians.

LIABILITY:
Service Provider shall not be liable for any damages to the irrigation system or property resulting from natural disasters, vandalism, or negligence by the Customer or third parties.

DISPUTE RESOLUTION:
The parties acknowledge that disputes may arise out of or relate to this Agreement. In the event of any such dispute, the parties agree to attempt to resolve it through friendly negotiations conducted in a mature and professional manner. Both parties shall make reasonable efforts to engage in open and constructive discussions to reach an amicable resolution.

GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws.

ENTIRE AGREEMENT:
This Agreement constitutes the entire understanding between the parties concerning the subject matter herein and supersedes all prior agreements, written or oral, between the parties.

EXECUTION:
This Agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.
